These Sales Terms and Conditions govern the use of the services of the online store and the use of the website www.supercostablanca.es of SUPERMERCADO COSTABLANCA S.L. (henceforth Costablanca), registered office located at Camí de la Mar, number 30, postal code 03580, Alfaz del Pi (Alicante) inscribed in the Mercantile Registry of Alicante, Volume 42149, Page 174, Sheet B-401884 and Tax Identification Number B-65410011.
Both the navigation and the utilization and /or acquisition of any of the services offered on this site, confer on you the title of User and supposes the full acceptation, without any reservations, of all and each of the Terms and Conditions valid at the moment that you, the User, (henceforth, "User") access the webpage Costablanca.es. At any time and without previous notification, these Terms and Conditions can be modified. For this reason, the User is obligated to read Terms and Conditions each and every time the User accesses the website Supercostablanca. The Terms and Conditions that are published on the website Supercostablanca at the time the User utilizes the website services offered by Costablanca are considered valid and applicable.
Access to and/or use of said services and content supposes the full and unconditional acceptance by the User of the Terms and Conditions published by Costablanca on the website Supercostablanca.es at the time the User accesses or uses said website.
The User certifies that he/she is above the age of majority and has the judicial capacity to enter into contract with these Terms and Conditions, as well as having read and understood the content of the same. Likewise, the User expressively accepts without exception that the access to and use of this website and its contents is his/her sole and exclusive responsibility.
The User should register as such by completing a registration form with an identifying User name and a password which will be personal and non-transferable. These will allow the User to effect a purchase from Costablanca of those products in which the User is interested.
Registration as a User is free of charge and during the first session will not be necessary until the order is finalized.
The registered User agrees to use correctly and keep secret the username and password that are assigned to him/her to access our services. The User will accept the costs and damages that may occur from the use of our services by any third party that makes unauthorized use for that purpose of the Username and password, or resulting from the loss of the Username and password by the User. In case of loss and to prevent unauthorized use of the Username and password, the user should contact Costablanca immediately.
Only one client per delivery address is permitted; however the same client can have different delivery addresses associated with a same user account.
Users can order from the Internet site: www.supercostablanca.es. Each user of Costablanca declares him/herself to be of legal age of majority and that he/she has full legal capacity to use credit cards and PayPal accounts, and declares that he/she has sufficient funds to cover the costs incurred by the purchase of products from supercostablanca.es
By clicking on the "Pay" button during the shopping process, the User declares full acceptance and without reservation the totality of the actual Terms and Conditions.
DATA AND SHIPPING
The information registered in supercostablanca.es constitutes proof of the transactions carried out between Costablanca and the User. Costablanca will confirm the order by email. Therefore and for added security, the creation of User accounts by temporary email services is not permitted.
Contractual information will be available in Spanish and in English.
The contents of this Supermercado Costablanca website are governed by Spanish laws and in the Spanish language, the English translation being only for interpretive purposes and for the convenience of our clients.
Shipping costs will be the following:
Our shipping policy has a limit for large orders of liquid packs (water, soft drinks, beers, juices, wines...). Please note that we do not have a store on every corner and we do not have a fleet of our own. Therefore, we have limited purchases up to certain quantities of liquids. If for any reason you manage to skip our computer limits, we will notify you immediately, removing excess products from your order and making a refund immediately (both for the price of the products and the proportional cost of those products in the shipment).
The corresponding taxes are included in our prices.
Costablanca reserves the right to modify prices at any moment; however the products will be invoiced based on the tariffs valid at the moment of placing the order (to reserve the availability of the product), excepting typographic or informatics errors.
Costablanca reserves the right to unilaterally cancel an order if the transport conditions are inadequate economically and/or operationally unviable. Likewise, Costablanca reserves the right to cancel any order whenever deemed appropriate.
The images of the products offered are illustrative only and might not coincide with that of the product offered since the manufacturers and brands are continually renovating their packaging. Nonetheless, Costablanca makes a daily effort to update all the information so that the product received is the one shown on the website.
Costablanca strives to please all of its users' demand for products. In the event that a product is unavailable after completing an order, the User will be notified either by email or by telephone at the number registered by the User and he/she will be given the option to cancel the entire order or to modify it including the corresponding economic modification.
Depending on the type of credit card used for the purchase and the specific bank conditions, the refund hold may take several days to be deposited in the User's account..
Payment for purchases can be made by credit card, through PayPal or Cash on Delivery (this last one will only accept cash and not credit cards). Accepted credit cards of are Visa and MasterCard. In the event that the Point of Sale terminal declines the credit card, the order will be automatically canceled and the client informed.
For your security, Costablanca has adopted the payment gateway system Redsys for payment by credit card. Redsys has been developed complying with the standards and specifications of international brands (as verified by Visa, MasterCard SecureCode, J-Secure...) which ensures its reliability. In addition, the Redsys gateway also has a Secure Authentication System (SAS) to provide cardholders with secure authenticated payments in their online purchases.
Only the bank and PayPal have access to the banking data associated with the means of payment. Costablanca does not have access to or register banking data during the payment operation nor at any other moment.

If the User no longer wishes to belong to Costablanca, he/she should send an email specifying a desire to cancel to firstname.lastname@example.org and the account will be canceled and all data referring to the account removed.

If you live in a community with personal or electronic surveillance, you must provide the delivery person with the necessary authorizations.
Each delivery is considered completed at the moment the product is placed by the shipper at the User's disposal, at the address the User specified when completing the order, as certified by the control system of the shipping company.
Receipt of the order implies that the client is in agreement with the general conditions of the supermarket as outlined on the website and with the total content of the order. If there should be any problem with your order, we advise you to notify us immediately so that our Customer Service department can resolve it as soon as possible.
In the event that the package arrives torn, wet, resealed with a tape that does not have the Costablanca logo, or the User believes that the contents may be damaged, it is very important that the User should note this incidence on the shipping form at the moment of delivery and that and follow-up as soon as possible by email to firstname.lastname@example.org with the corresponding photographs of the damaged package or products. An invoice can be generated during the order payment process. If for some reason it is not generated at this time, the User can generate the invoice from his/her session by clicking on the order or by sending an email to email@example.com. The maximum time limit is the 16th of the month following following that of the purchase date (Royal Decree 1496/2003).
Costablanca reserves the right to modify its Terms and Conditions without previous notice, being able to change, eliminate or add contents as well as services offered by them as well as the manner in which these are presented or located in their servers.
These changes should be accepted by the User each and every time he/she makes a purchase through the website supercostablanca.es.
If any term included in the current Terms and Conditions were declared, totally or partially, null or ineffective, such nullity or ineffectiveness would affect only that disposition or the part of it to which it refers, not affecting the remaining general conditions in their totality or any other part of the conditions.
